All Things D: One of the longest, most vicious tech industry lawsuits ever is about to repeat itself. Oracle has opted for a re-trial of its case against former SAP subsidiary TomorrowNow. Oracle originally won a $1.3 billion judgment in the case, but a judge knocked the award down to $272 million because she said the original amount was “grossly excessive.” Rather than accept that reduced judgment, Oracle has filed papers to re-try the entire case.

Oracle accused TomorrowNow of stealing some of its  source code and making copies of the software without paying licensing fees.
