The Wall Street Journal: Samsung has said that it expects to add the iPhone 5 to a patent infringement lawsuit it has filed against Apple. “Based on information currently available, Samsung expects the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models,” said Samsung’s lawyers. “Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights.”

The case is scheduled to go to trial in 2014, meaning that any action taken in the case is unlikely to impact initial sales of the iPhone 5. Samsung and Apple have each accused the other of violating eight patents on mobile technology.

This new patent lawsuit is separate from the high-profile case that wrapped up in August. In that case, the jury ruled that Samsung infringed on six Apple patents and that Apple didn’t infringe on any Samsung patents.
