Apple Requests Samsung Sales Ban, Additional Damages

The court battle between Apple and Samsung continues. After winning a jury verdict in its recent patent lawsuit, Apple is asking the court to ban sales of additional Samsung’s products and to raise the more than $1 billion verdict by an additional $707 million. Meanwhile, Samsung is seeking a new trial.

Reuters reported, “In a motion filed late Friday U.S. time, Apple sought a further $400 million damage award for design infringement by Samsung; $135 million for willful infringement of its utility patents; $121 million in supplemental damages based on Samsung’s product sales not covered in the jury’s deliberation; and $50 million of prejudgment interest on damages through December 31. The requests together come to $707 million.”

Cnet’s Roger Cheng added that Apple’s motion also seeks a more widespread ban on Samsung’s products: “Following the victory, Apple sought to ban the products mentioned during the trial. The company is now seeking to extend that ban to any Samsung products that potentially infringe on its design patents, which could extend to Samsung’s current flagship Galaxy S3.”

TechRadar noted that Apple claimed Samsung had cause irreversible “damage to the iPhone’s distinctive product identity.” Apple added, “Samsung has reaped extraordinary rewards from its wrongful sale of iPhone and iPad clones by taking market share, revenues, and profits from Apple.”

However, Samsung plans to continue the fight. ZDNet’s Spandas Lui reported, “Samsung has requested a new trial, claiming that it wasn’t given a fair go during the legal proceedings. The Korean vendor has also found inconsistencies in the way the jury came up with the US$1 billion payout figure.”
