Microsoft Sues Motorola Mobility, Claims Patent Abuse

Cnet: Microsoft has filed a formal complaint against Motorola Mobility with the European Commission. The software maker says that Motorola refuses to licenses standards-related technology on FRAND (fair, reasonable, and nondiscriminatory) terms. According to Microsoft attorney Dave Heiner, Microsoft pays Motorola $22.50 in royalties for each $1,000 laptop in order to license 50 patents. By comparison, Microsoft pays 29 other companies “2 cents for use of more than 2,300 patents.”

“In legal proceedings on both sides of the Atlantic, Motorola is demanding that Microsoft take its products off the market, or else remove their standards-based ability to play video and connect wirelessly,” Heiner wrote. “Motorola is on a path to use standard essential patents to kill video on the Web, and Google as its new owner doesn’t seem to be willing to change course.”
